These Terms of Service (“Terms”) govern your access to and use of the website breezibreathing.com, the Breezi Breathing mobile application, and any related services (collectively, the “Services”) provided by Breezi Breathing (“Breezi Breathing,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You may use the Services only if:

• You are at least 13 years old; and
• You have the legal capacity to enter into a binding agreement in your jurisdiction.

If you are using the Services on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf.

2. Health Disclaimer (Not Medical Advice)

Breezi Breathing provides educational content and breathing-related guidance for wellness, performance, and stress management purposes only.

• The Services do not provide medical, psychological, or other professional healthcare advice, diagnosis, or treatment.
• The Services are not a substitute for professional medical care.
• Do not ignore or delay seeking professional medical advice because of something you have read or practiced within the Services.
• If you have any medical condition (including cardiovascular, respiratory, neurological, or psychiatric conditions), or are pregnant, consult a licensed healthcare provider before using breathing exercises or following any recommendations from the Services.
• Stop using the Services and seek medical help immediately if you experience dizziness, chest pain, shortness of breath, fainting, or any other concerning symptoms.

Emergency Use: The Services are not intended for emergency or crisis situations. In an emergency, call your local emergency number immediately.

3. Accounts and Security

To access some features, you may need to create an account. You agree to:

• Provide accurate, current information;
• Keep your login credentials secure; and
• Notify us promptly at support@breezibreathing.com of any unauthorized use or security breach.

You are responsible for all activity under your account.

4. Subscriptions, Payments, and Billing

Certain features of the Services may be offered as paid subscriptions, one-time purchases, or in-app purchases.

• Prices, subscription terms, and available plans are displayed within the app or on the website and may change from time to time.
• Payments may be processed by third-party payment processors (such as Apple, Google, Stripe, or similar). We do not store full payment card details.
• Where purchases are made through an app store (e.g., Apple App Store, Google Play), the store’s own terms and refund policies may apply.

Unless stated otherwise:

• Subscriptions may automatically renew at the end of each billing period;
• You can cancel auto-renewal at any time through your account settings or app store settings before the next billing cycle; and
• Fees already paid are generally non-refundable, except where required by applicable law or the app store’s policies.

5. License and Acceptable Use

5.1 License Grant

Subject to these Terms, Breezi Breathing grants you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the website;
• Download, install, and use the Breezi Breathing app on a device you own or control; and
• Use the Services solely for your personal, non-commercial use (unless otherwise agreed in writing).

5.2 Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose;
• Reverse engineer, decompile, or attempt to derive the source code for the app or website;
• Circumvent, disable, or interfere with security-related features;
• Use any automated means (bots, scrapers, etc.) to access or collect data from the Services;
• Upload or transmit any viruses, malicious code, or harmful content;
• Harass, abuse, or harm other users; or
• Use the Services in any way that could damage, disable, or impair our servers or networks.

We may suspend or terminate access to the Services if we believe you have violated these Terms.

6. Intellectual Property

All content and materials in the Services—including but not limited to text, graphics, logos, icons, images, audio, video, software, and trademarks—are owned by Breezi Breathing or its licensors and are protected by intellectual property laws.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Services; or
• Use any Breezi Breathing trademarks or branding without our prior written consent.

7. User Content

If you submit, upload, or otherwise provide any content to us (such as feedback, reviews, or suggestions):

• You retain ownership of your content; and
• You grant Breezi Breathing a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of operating, improving, and promoting the Services.

You represent and warrant that:

• You have the necessary rights to provide the content; and
• Your content does not infringe any third-party rights or violate any laws.

We may, but are not obligated to, remove or modify user content at our discretion.

8. Third-Party Services and Links

The Services may contain links to third-party websites, apps, or services, including payment providers, analytics tools, or social platforms.

• We do not control and are not responsible for the content, policies, or practices of third-party services.
• Your use of third-party services is at your own risk and subject to their terms and privacy policies.

9. App Store Terms

When you download or use the Breezi Breathing app from an app store (such as the Apple App Store or Google Play):

• You acknowledge that the app store provider is not a party to these Terms;
• The app store provider is not responsible for maintenance, support, or warranties for the app; and
• To the extent permitted by law, the app store provider has no liability for any claims relating to the app or your use of it.

You must also comply with the app store’s terms and conditions.

10. Termination

We may suspend or terminate your access to the Services, with or without notice, if:

• You violate these Terms;
• We are required to do so by law; or
• We decide to discontinue the Services.

You may stop using the Services or delete your account at any time.

Even after termination, certain provisions of these Terms will remain in effect, including intellectual property, disclaimers, limitations of liability, and indemnification.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied.

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free;
• Any particular results, health outcomes, or performance improvements will occur; or
• Any defects will be corrected.

You use the Services at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

• Breezi Breathing and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or data, arising from or related to your use of (or inability to use) the Services.
• Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid (if any) to Breezi Breathing for access to the Services in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Breezi Breathing and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Services;
• Your violation of these Terms; or
• Your violation of any applicable law or third-party rights.
